Establishment closure due to serious infractions

The one-year closure of a Magaluf establishment was decreed due to two very serious infractions

Calvià Town Hall has decreed the one-year closure of a well-known leisure establishment, located on camí de sa Porrassa in Magaluf, for the commission of two offences typified in Law/2013, on the Legal Regime for installation, access and carrying out activities in the Balearic Islands as very serious, and imposes a financial penalty of 115.000 euros.

The first infraction occurs when it is verified, in a joint action between the Local Police and the Civil Guard, that said establishment exceeded the maximum capacity limit, which could create a dangerous situation for the safety and physical integrity of people, therefore the people who remained inside were evicted, accounting for 254 people and 8 workers, exceeding the maximum capacity allowed by 48% (173 people). In this case, it is an infraction classified as very serious, according to Article 104.d of Law/2013, on the Legal Regime for installation, access and carrying out activities in the Balearic Islands, for exceeding the maximum capacity foreseen in the regulations in force, in the project, in the technical documentation or in the authorisation, in a 20% or more in the establishment or in the area of the establishment.

As a result of this control, a minor under 12 years of age is located inside the establishment, in a drunken state, carrying in her hand a glass from which she was drinking, with alcoholic content. This situation violates Article 104.m of Law 7/2013, on the Legal Regime for installation, access and carrying out activities in the Balearic Islands, which considers it a very serious offence to allow minors to enter places where it is not allowed.

The establishment's ownership must pay a fine of 52.500 euros for each of the infractions, and the total closure of the activity has been ordered for a period of one year, after dismissing the appeals for reversal submmitted to the sanction filing resolution.
